Terms and Conditions
Last updated: 22 October 2026
These Terms and Conditions ("Terms") apply to your use of this website and to digital products made by Top End Smart Homes ("TESH", "we", "us"), a sole trader business based in Darwin, Northern Territory, Australia. By using this site or buying a product, you agree to these Terms.
1. Products
We sell digital Home Assistant dashboard kits, automation blueprints and related files ("Products"), supplied as zip downloads. Products are software and configuration files only. Product descriptions, requirements (such as the minimum Home Assistant version) and prices in Australian dollars are shown on the Kits page. Screenshots and videos use demo data.
2. Ordering and payment
Orders are processed by Lemon Squeezy, our reseller and merchant of record. Lemon Squeezy handles payment, applicable taxes (including GST), invoicing and delivery, and its own terms also apply to your purchase. Prices may change, but changes do not affect orders already paid for.
3. Delivery by download
Products are delivered digitally. After payment you receive a download link on the checkout confirmation page and by email from Lemon Squeezy. No physical goods are shipped for digital Products. If you have trouble downloading, email us and we will help.
4. Licence
When you buy a Product, we grant you a non-exclusive, non-transferable licence to download, install, use and modify it for your own personal, non-commercial use in your own home(s). You may not:
- resell, sublicense, share, redistribute or publish the Product or any modified version of it, whether free or paid;
- include the Product in another product, template, kit or service offered to others; or
- use the Product to provide paid installation or setup services to others without our written permission.
We (or our licensors) keep all intellectual property in the Products. Third-party components referenced by a Product (such as free community add-ons) are covered by their own licences.
5. Refunds and Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Because Products are digital and delivered instantly, we do not offer refunds for change of mind (for example, if you no longer want a Product or bought the wrong edition). This does not limit your rights under the ACL: if a Product has a major failure, is not as described, or is not fit for its stated purpose, you are entitled to a remedy, which may include a repair, replacement or refund. To make a claim, email us with your order number and a description of the problem. Refunds are processed through Lemon Squeezy.
6. Requirements and compatibility
You are responsible for checking that your system meets the stated requirements before buying. Products depend on third-party software, data feeds and services (such as Home Assistant, weather and emergency-service data) that may change or stop working outside our control. We will make reasonable efforts to provide updates but do not promise that every feed will remain available.
7. Not a warning system
Dashboards are informational only and are not a warning system. Do not rely on them for safety decisions. Always follow official advice from emergency services and the Bureau of Meteorology, and in an emergency call 000.
8. No electrical or wiring advice
We do not provide electrical or wiring advice, and nothing on this site, in our Products, tutorials or videos is such advice. Any fixed electrical wiring must be carried out by a licensed electrician. We recommend plug-in and battery devices only.
9. Not affiliated with Home Assistant
Top End Smart Homes is an independent business and is not affiliated with, endorsed by or sponsored by Home Assistant, Nabu Casa or the Open Home Foundation. Home Assistant and other product names are trademarks of their respective owners and are used only to describe compatibility requirements.
10. Limitation of liability
To the extent permitted by law (including the ACL), we are not liable for indirect or consequential loss, or for loss caused by third-party software, services, devices or data feeds. Where our liability for a failure to meet a consumer guarantee can be limited, it is limited to supplying the Product again or refunding the price you paid.
11. Website use
Website content is provided for general information. You must not misuse the site or copy its content for commercial purposes. Links to third-party sites are provided for convenience and we are not responsible for their content.
12. Privacy
Our handling of personal information is described in our Privacy Policy.
13. Governing law
These Terms are governed by the laws of the Northern Territory, Australia, and you submit to the non-exclusive jurisdiction of its courts. Nothing in these Terms limits rights you have under consumer protection laws that apply to you.
14. Changes
We may update these Terms from time to time. The version in force when you buy applies to that purchase.
